Electronic signature on the apply form
When you submit the apply form on this website you are electronically signing and accepting these Terms of Use together with the Myfy Privacy & Mandate Agreement (v1.2) in full. Your submission is treated as an enforceable electronic signature under the Electronic Transactions Act 1999 (Cth), with the same legal effect as a handwritten signature on a paper copy. By submitting the form you confirm that you have authority to bind your business, and that the information you have given is true and complete.

Myfy is a finance comparison and matching service operated in Australia. Myfy is not a lender and does not provide credit. All credit products are provided by independent third-party lenders, who are responsible for the assessment and approval of applications.

90-Day Exclusive Finance Mandate
By submitting the apply form you grant Myfy the sole and exclusive authority to act on your behalf to seek, negotiate, structure and arrange finance, and you agree not to engage any other finance broker, consultant or lender directly for these purposes while the mandate is active. The exclusive mandate is strictly valid for 90 days from the time of signing. During that 90-day period, Myfy is your broker of record for any lender Myfy introduces or approaches on your behalf — including any restructure, renewal, increase or top-up of an introduced facility — regardless of whether the finance settles within the 90-day window.
The mandate does not lock you in to accepting any particular offer. You remain free to decline any offer Myfy presents to you. However, while the mandate is in force you agree to deal with Myfy-introduced lenders only through Myfy, and you agree that any fees, commissions or trail payable to the broker on those introductions are payable to Myfy. Full mandate terms are set out in section 1 of the Privacy & Mandate Agreement.
Consents you give when you submit the form
Submitting the apply form also gives Myfy the consents set out in the Privacy and Mandate Agreement: credit check authority (Part IIIA of the Privacy Act 1988 (Cth)), lender and partner sharing, read-only banking data via our bank-data partner, identity verification under the AML/CTF Act, use of your information for our service, and marketing communications by email, SMS and phone. You can opt out of marketing at any time using the unsubscribe link in any marketing email, by replying STOP to any marketing SMS, or by emailing privacy@myfy.com.au.
Your representations
By submitting the apply form you represent that: (a) you are at least 18 years old; (b) you have authority to bind the business named on the form; (c) the information you have provided is true, complete and not misleading; (d) any guarantor identified has consented to your providing their information; and (e) you have read and accept the Privacy & Mandate Agreement in full.
Acceptable use
You agree not to misuse the site, attempt to interfere with its operation, or submit false information through any application form. We reserve the right to refuse service or cancel applications where we suspect fraudulent or non-genuine use.
Liability
To the maximum extent permitted by Australian Consumer Law, Myfy is not liable for any indirect or consequential loss arising from use of the site. Our liability for any direct loss is limited to the resupply of services or the amount paid by you (if any) for the relevant service.
Governing law
These terms are governed by the laws of New South Wales, Australia, and you submit to the exclusive jurisdiction of the courts of New South Wales for any dispute arising out of or in connection with these terms.
Changes
We may update these terms from time to time. Material changes will be flagged on the site and the "last updated" date refreshed.
